Public Hearing of
October 15, 2003

I.      CALL TO ORDER - 9:05 p.m.

        Chairman Philip Lindquist advised all present that the meeting was being tape recorded and reviewed the agenda for the public hearing. He asked if all abutters had been properly notified and was advised by Administrative Assistant Barbara Ferguson that certified mail receipts for all abutters had been received by the Planning Board office.  Vice Chairman Gerard LeBlanc read the following public hearing notice published in The Enterprise on October 1 & 8, 2003.

PUBLIC HEARING NOTICE

        The Hanson Planning Board will hold a public hearing on Wednesday, October15, 2003 at 9:30 p.m. in the Hanson Town Hall, 542 Liberty Street, Hanson, MA on a definitive subdivision plan showing a 12-lot residential subdivision Off Main Street.  The plan is further identified as Parcels 1-6. 1-5. 1-9, 1-8, 1-11, 1-12, 1-13, and 1-14 on Assessors Map 44. Deed to said property is recorded in Plymouth District Registry of Deeds, Book 23024, Pages 74 and 75.  The subdivision, entitled Brookside Estates, is located in Hanson, MA and dated June17, 2003 by
GCG Associates, Inc. 226 Lowell Street, Wilmington, MA 01887. The plan was submitted by
Chilmark Company, 345 Washington Street, Pembroke, MA 02359.  A copy of the subdivision
plan is available in the Hanson Town Clerk’s Office and in the Planning Board office for review.

II.     Presentation of plans from applicant/engineer

        Jeremy Downs of GCG Associates, Inc. of Wilmington told the Board that the 16-acre site of the proposed residential definitive subdivision to be known as Brookside Estates is located on the south side of Main Street about half way between Franklin Street and Elm Street . The majority of the site, is in the Commercial-Industrial Zoning District with a portion in the Agricultural-Recreation District, he said.  The property is also in the Flexible Zoning District and in a Zone II Aquifer Protection District.  He noted that a subdivision, also called Brookside, was approved for industrial-commercial development in a similar layout in 1988.  The topography of the site, he said, starts at a high point on Main Street and then gently slopes to the southern and western property boundaries.  The wetlands have been flagged on the western and southern perimeters.  The property is located 200 feet from Poor Meadow Brook.   The proposed plan indicates 12 lots, two roads, and two cul-de-sacs. Street drainage systems will discharge to three detention ponds and then through spreaded swales to the wetland area.  There will be individual septic systems and a sidewalk on one side of the roadway.  Eight inch water mains will be installed for fire protection.

        John & Marion Rasch - Mr. Rasch asked where the water for the development would be coming from and was told each lot would have an individual well.  He said that even private wells could impact the town’s water supply which is located across the street from the development.  He also told the Board that the Mr. and Mrs. Lelito no longer live at 958 Main Street

IV.     Questions from public

        There were no questions or comments from the public.

V.      Questions/Comments from other Town Boards/Departments

        A.      Police Department

        No response was received to the Board’s September 18, 2003 memo seeking input.

        B.      Water Department

        In an October 10, 2003 memo to the Board, Water Superintendent Glen Doherty noted the project in is a Zone II Water Protection District in close proximity to Poor Meadow Brook.  Any water off Brockton’s water main, he said, will have to be worked out with the Board of Water Commissioners.

        C.      Fire Department

        In an October 7, 2003 memo to the Board, Fire Chief Allen Hoyt noted that water mains must be looped in both cul-de-sacs and that both cul-de-sacs must have a minimum 50 foot inside turning radius.

        D.      Board of Health

        In a September 24, 2003 memo to the Board, Health Board Chairman Gilbert Amado stated that as of that date his office had not been contacted to witness percolation tests.

        E.      Building Inspector

        In an October 14, 2003 memo to the Board, Building Inspector/Zoning Enforcement Officer Michael Kennedy noted that Lots 10 & 12, shown on the plan as corner lots, must have 150 feet of frontage on both roads. This frontage requirement, he said, should be maintained for 100 feet back from the roadway.
        G.      Conservation Commission
        
        In a September 30, 2003 memo to the Board, Conservation Agent Tricia Cassady noted that stormwater calculations need to reflect that the project falls within a Zone II water recharge area.  She asked how the mean annual high water and bank were determined for Poor Meadow Brook and from what point on the brook the 200-Riverfront Area was determined.  She said that the roadways and stormwater management structures may require the filing of a Notice of Intent with the Conservation Commission and that seven lots, as proposed, will be subject to a Notice of Intent filing.

        H.      Highway Surveyor

        No response was received to the Board’s September 18, 2003 memo seeking input.
        
VI.     Questions from Planning Board Members

        David Nagle asked if the cul-de-sacs had islands and was told at the present they do not.  Gerard LeBlanc advised that the Board prefers sloping granite curbs on both the inside and outside of an island. Joan DiLillo asked if the roads had been staked and was told they had not. Mr. LeBlanc advised that the detention basins must be dry within 24 hours.  Chairman Lindquist added that the basins should have three feet or less of water in a 100-year storm  Mr. Coyle advised the engineer to review the Building Inspector’s comments regarding the frontage requirements for corner lots.

VII.    Comments from Board’s Engineer, P.M.P. Associates

        Chairman Lindquist read a five-page October 15, 2003 letter from Michael Perrault of P.M.P. Associates of East Bridgewater, reviewing the project for the Board.  In his review Mr. Perrault cited deviations from the Planning Board’s Rules and Regulations relative to sections 5.2, 5.4, 5.5, 5.7, 5.8, 6.1, 6.5.1, 6.5.6, 6.6, 6.7, 7.4.1, 7.4.31, 7.4.34, 7.4.38, 7.4.44, 7.4.45, 7.4.46, 7.5, 7.6.1, 7.9, and 7.10.  He also made eight comments on the Stormwater Management features.  In conclusion, Mr. Perrault suggested that the design engineer met with him to discuss the drainage design and resolve drainage issues and concerns.  He recommended that the Board continue the public hearing to allow the design engineer time to address the issues raised in his review.
